By Your Side As You File For Permanent Total Disability Benefits

Some workplace accidents cause catastrophic, disabling injuries that prevent the injured worker from ever holding gainful employment again. Permanent total disability (PTD) benefits are available when this occurs. Permanent total disability benefits are paid weekly for at least 450 weeks. If after 450 weeks of benefits you are still totally disabled, the payments continue.

These claims can be very complicated, involving nuances that only an experienced workers’ compensation lawyer will be aware of. For more than 50 years, people across New Jersey have entrusted the Law Offices of Kaplan & Kaplan, P.C. to handle their workers’ compensation claims. You can count on our vast experience and our tenacious work effort to tirelessly advocate for your total disability benefits.

How Is Total Disability Determined?

After a workplace injury, you will go through a period of treatment, rehabilitation and any other steps necessary to improve your condition. Eventually, you will reach your maximum medical improvement (MMI). Next, you will be evaluated by expert doctors to determine if you are unable to work. After these examinations are complete the case is ready to be heard by the Judge.

How Much Compensation Is Available To A Totally Disabled Person?

In New Jersey, permanent total disability is equal to 70 percent of the workers’ average weekly wage. As mentioned above, PTD is paid for 450 weeks, at which point you must re-evaluated  to ensure that you are still unable to work. If you are, then the PTD payments continue.
