Promoting Your Welfare After You Have Lost A Loved One

The untimely death of a spouse or parent is devastating. The emotional pain and grief of this loss may never completely go away. The death of a loved one can create financial concerns as well. You and your family depend on the income your loved one earned. The loss of this income can make it difficult to sustain the same standard of living.

Dependents of a person who has died as a result of a workplace injury or illness have the right to recover dependency or death benefits under New Jersey’s workers’ compensation laws. A knowledgeable lawyer at the Law Offices of Kaplan & Kaplan, P.C. can help you understand your rights and recover these benefits. We help clients from Essex County, Bergen County, Passaic County, Morris County and throughout New Jersey.

Who Is Entitled To Dependency Or Death Benefits?

The surviving spouse and natural children who were part of the household at the time of death are presumed to be dependents. Dependent children can receive their parents’ death benefits until the age of 18 or 23 if they are full-time students. If a child is physically or mentally disabled, he or she may be eligible for further benefits.

Other alleged dependents such as parents, grandparents, brothers and sisters may be entitled to receive death benefits. Over their careers, attorneys Kenneth and Bernard Kaplan have helped numerous families recover dependency benefits. Under New Jersey law, the following benefits are available:

  • Dependents of a worker who dies as a result of a work-related injury or illness are eligible to receive weekly payments totaling 70 percent of the deceased’s gross weekly wage, subject to statutory limits.
  • The employer or its insurance carrier is responsible for paying up to $3,500 in funeral expenses for a job-related death.
